Certain Toast products and services may offer generative artificial intelligence (“GAI”) capabilities. Generative AI refers to a category of AI algorithms that are trained on data sets and that can generate text, images, video, sound, or other work product (output) in response to prompts (input).
GAI is moving quickly, and new technology also comes with new risks and responsibilities for those using that technology. These guidelines and best practices are designed to help you understand how we have implemented GAI into our email marketing product and to provide guidance on using our GAI tools responsibly. As always, please work with your own legal advisors to understand your specific legal obligations and responsibilities.
General Overview: responses created by GIA (“Outputs”) can vary vastly depending on things like user inputs/prompts and the data the tool is trained on. Outputs are often based on patterns “learned” from existing data, and results may improve through subsequent tries or refining prompts. Importantly, because outputs are based on underlying data, prompts, and patterns, outputs may be incorrect, inaccurate, offensive, illegal, harmful, discriminatory, or biased. Some GAI tools may be trained on information they did not have permission to train on. Toast does not have visibility or control over the models' third-party tools use for training, and by using any GAI tool, even through Toast, you are accepting the risk in this regard.
Because of this, human review is a critical step in using GAI tools. We require human review of all Outputs generated using Toast-provided GAI tools before that content is published or widely shared. As a customer, you are responsible for any Outputs you disseminate.
AI output might be wrong, offensive, or illegal. As discussed above, due to the nature of GAI, outputs generated using Toast’s Generative AI-powered Marketing Assistant could be inaccurate, offensive, biased, harmful, or infringing. You are responsible for any output you use as if you were the original or sole creator, so you should always thoroughly review output before using it. The tool allows you to make edits to refine content before you send it to your guests.
Note: Toast does not control or review any marketing content generated by Toast’s Generative AI-powered Marketing Assistant. You, as a user, are solely responsible for ensuring that there is a human review of all output and for confirming that the output is appropriate and lawful.
Inputs are shared with third-party AI providers. Your input will be shared with third-party AI providers and may be used to train their models. Accordingly, be thoughtful about the data you input in Toast’s Generative AI-powered Marketing Assistant, and do not input any confidential, personal, or sensitive information.
Ownership over the content you generate with our AI features. Even if you generate content based on original inputs using our GAI tools, you may not be the owner of this content. This is for two reasons (1) if the output is similar to others’ content, including content that is already protected by trademark or copyright law, you may not be able to claim ownership over it (and the original owner might be able to claim that your use infringes their intellectual property rights); and (2) the US Copyright Office hasn’t yet determined if and when AI-assisted content should get copyright protection.
Transparency is Crucial. You should always share when the content you’re using was generated using GAI. This is particularly important when it’s possible that someone could potentially be misled or harmed by the content.
We rely on third parties to power some of our AI features, including Toast’s Generative AI-powered Marketing Assistant. Currently, this product is powered by OpenAI. OpenAI has its own set of terms and policies that apply to your use of their products, and you should review their terms and policies here. You must comply with OpenAI’s Usage Policies when using our AI-powered features. Remember that any data you provide as input will be sent to OpenAI and handled by them in accordance with their policies. Toast does not take any responsibility for any of OpenAI’s practices, which we have no control over.
