Paid Sick Leave Overview

Some employers are required to provide paid sick leave to their employees. Mandated paid sick leave generally requires employers to provide employees an amount of time that can be used for the following reasons impacting an employee or a member of the employee's family:

  • Illness or injury;
  • Medical diagnosis, care, or treatment of an illness, injury, or health condition;
  • Preventive care or routine medical appointments, and/or
  • Any other covered purpose

 

The below charts summarize the default paid sick leave settings, based on a calendar year, configured in the Toast Payroll Time Away From Work module (the "Default Configurations") for certain states. Not all states have default configurations. If a state is not listed below, then no Paid Sick Leave policy will be set up for employees with work locations in that state. The Configurations below may or may not satisfy the needs of each employer. No representation or warranty is made - see your TOAST PAYROLL SERVICE AGREEMENT TERMS & CONDITIONS for details. It is each employer's responsibility to review the law, seek professional advice from their attorneys, accountants, and other professionals, as needed, and ensure that the leave policies that they have selected comply with applicable law.

 

Since each jurisdiction has different paid sick leave requirements, the Default Configurations may not incorporate exemptions, employer size, alternative ways of providing leave, or other variables necessary for your operations. As such, the Configurations may not be appropriate for your situation. Additionally, the below Default Paid Sick Leave Configurations are only related to paid sick leave, and do not include any paid family leave, paid or unpaid family & medical leaves, state or federal contractor-required leaves, COVID-19 paid-leave laws, or any other type of leave requirements.

 

Please review the Default Configurations below that will apply to you and your employees, based on the restaurant location listed in each employee's profile, if you take no action. Only one configuration can be applied to each employee at any given time.

 

Once configured, it is your responsibility to update your paid sick leave configures over time, including to ensure compliance with applicable or changing laws.

  • Exempt employees are assumed to work 40 hours per workweek;
  • Default Configurations are configured and administered on a calendar year basis; and
  • Compensation for accrued and unused paid sick leave is not provided upon separation from employment.
 

Requirements regarding paid sick leave accrual, carryover, use, pay out, recordkeeping, and more, may vary by jurisdiction and/or other variables. As such, the Default Configurations may not be suitable for your circumstances. Definitions for Paid Sick Leave

  • Accrual Rate: the rate at which the paid sick leave benefit accumulates over a specified period of time for each employee
  • Accrual Cap: the maximum balance that each employee can have accumulated at any given point in time
  • Paid Sick Leave Accrual Begins: the date on which the employee can begin accumulating their accrued paid sick leave
  • Paid Sick Leave Use Begins: the date on which the employee can begin using their accrued paid sick leave
  • Taken Hours Limit/Maximum Paid Sick Leave Use Per Calendar Year: the maximum amount of accrued paid sick leave that an individual employee may take in a given calendar year
  • Carry Over: the amount of unused accrued paid sick leave that an employee retains after the end of a given calendar year into the following calendar year

 

 

Paid Sick Leave Paystub Requirements

On employee paystubs, all default policies show the balance of paid sick leave available for the current year, the amount of sick time earned in the pay period, the amount of leave taken during the current year, and the amount of pay that an employee received for paid sick leave in the current year. Some jurisdictions require information on paid sick leave is shown on paystubs. For example, in Arizona, the paystub must show the amount of earned paid sick time available to the employee, the amount of earned paid sick time taken by the employee to date in the year, and the amount of pay the employee has received as earned paid sick time.

 

You can choose to remove the paid sick leave balances, but you should review requirements that are applicable to your business before doing so. If you decide to remove these balances, contact your Onboarding Coordinator if you are not live with Toast Payroll yet. Default Paid Sick Leave Configuration FAQ

What happens if I operate multiple locations?

Each employee can only have one Default Configuration. Default Configurations are based on the employees' work location.

 

What happens if my employees are in a jurisdiction that has both a local Default Configuration and a state Default Configuration?

If we apply a Default Configuration at all, we will apply the local Default Configuration to that employee.

 

What happens if one employee works across states (or localities with distinct policies)?

Only one configuration can be selected for each employee. You can let us know which Default Configuration, if any, you'd like applied to each such employee. Select the blue chat button in the lower-right corner of any Toast Payroll page to chat with us.

 

Is there a different calculation for salaried employee sick time accrual?

Salaried employee sick time accrual is based around the work week set in Toast Payroll. If you believe your salaried employees are not calculating sick time appropriately, contact us via the blue chat dot in the lower-right corner of any Toast Payroll page.

 

What happens if a sick law changes? Will Toast change the Default Configuration of my plan on my behalf in response to the state or local changes?

No. We will not change your configuration(s) unless you ask us to do so.

 

What happens if I want to offer a configuration that is different from what is specified here with the Default Configuration or if I want to make a change to an existing configuration?

Reach out to your Onboarding Consultant or our Customer Care team with the following specific information:

  • Restaurant legal entity name: 
  • Restaurant DBA name
  • EIN
  • The following changes shall apply to all employees working at restaurant locations located in the following state (only one state may be listed per form): 
  • Taken Hours Limit (i.e., the maximum amount of hours of paid sick leave per calendar year that an individual employee can take/use from however many hours the employee has accrued. If there is no limit, the numerical value would need to be specified as "0.") (Insert a single number): 
  • Start Balance (i.e., the starting amount of hours that an employee has accrued as of hire date, before employee ever works any hours): 
  • Accrual Rates (i.e., the rate at which paid sick leave is earned (i.e., for every hour of employment worked, how many hours of paid sick leave is accrued?)):  ____/hr
